1. About This Notice
BBC Global Footwear LLC (“BBC,” “we,” “us” or “our”) respects the privacy of individuals with whom we interact in the ordinary course of our business. This Privacy Notice explains how BBC collects, uses and protects personal data relating to business customers, prospective customers, credit applicants, suppliers, business partners and other persons with whom BBC has a commercial relationship.
BBC Global Footwear LLC is a Florida limited liability company owned by BBC International LLC and conducts European operations through its third party agent in the Netherlands (the “Netherlands Agent”).

For purposes of applicable data protection laws, including the General Data Protection Regulation (“GDPR”) and, where applicable, the United Kingdom GDPR (“UK GDPR”), BBC Global Footwear LLC is the controller of the personal data described in this Notice.
This Notice generally concerns information about individuals acting in a business capacity, such as owners, directors, officers, employees, representatives, accounts-payable contacts, bank contacts and trade-reference contacts. Information relating solely to a company or other legal entity generally is not personal data.
2. Information We Collect
Depending on the nature of our relationship, BBC may collect names, job titles and business contact information; information concerning business owners, directors, officers, representatives and beneficial owners; billing, shipping, account and transaction information; information provided in connection with a credit application; financial information, credit reports, credit ratings and credit-insurance information; bank and trade-reference information; payment history, balances and collection information; information used for fraud prevention, sanctions, export-control, anti-bribery and other compliance purposes; and correspondence and other information relating to our business relationship.
BBC does not seek sensitive personal information in connection with its commercial relationships or credit applications.
3. How We Obtain Information
We may obtain personal data directly from you; from your employer or another person within your organization; from a customer or prospective customer that identifies you as a representative, bank contact or trade reference; from banks, credit-reporting agencies, credit insurers and business-information providers; from publicly available corporate, court, insolvency, sanctions and similar records; and from BBC International LLC, other BBC group companies and service providers.
Where BBC receives personal data about an individual indirectly, such as when a credit applicant identifies a bank or trade-reference contact, BBC will provide or make available applicable privacy information as required by law, including in connection with BBC’s first communication with that individual where appropriate.
4. How We Use Personal Data
BBC may process personal data to establish and administer customer accounts; review credit applications and determine credit limits and payment terms; obtain and verify bank, trade and credit references; process orders, invoices and payments; communicate with customers and other business contacts; manage our commercial relationships; prevent fraud and protect BBC and its assets; conduct sanctions, export-control, anti-bribery and other compliance reviews; collect amounts owed to BBC; establish, exercise or defend legal claims; maintain financial, tax, customs and other business records; and comply with applicable legal and regulatory requirements.
In general, the categories of purposes under which BBC processes personal data are credit evaluation, account administration, fraud prevention, and collections purposes. BBC processes personal data where necessary for its legitimate business interests, including evaluating creditworthiness, managing commercial relationships, preventing fraud, protecting its business and assets, and establishing, exercising or defending legal rights; to perform or enter into a contract; to comply with legal obligations; or on another basis permitted by applicable law. BBC does not ordinarily rely on consent to process personal data arising from its B2B commercial relationships.
5. Credit Information
Where a customer applies for commercial credit, BBC may obtain information from banks, trade references, credit agencies, credit insurers and other business-information sources and may use that information to evaluate creditworthiness, establish or modify credit limits and determine appropriate payment terms.
6. Sharing Personal Data
BBC may share personal data where reasonably necessary with BBC International LLC and other BBC group companies; banks and payment processors; credit-reporting agencies, credit insurers and business-information providers; accountants, auditors, attorneys, collection agencies and professional advisers; logistics, customs and other providers involved in fulfilling customer orders; IT, hosting and other service providers; governmental, regulatory, tax, customs, judicial and law-enforcement authorities where required or permitted by law; and a purchaser, successor or adviser in connection with a proposed or completed corporate transaction.
BBC does not sell personal data obtained through its B2B relationships or credit applications.
7. International Processing
BBC is headquartered in the United States and conducts European operations through its Netherlands Agent. Accordingly, personal data collected in Europe or the United Kingdom may be accessed or processed in the United States. BBC may also use group companies and service providers located in the United States and other countries.
Where applicable data protection law requires safeguards for an international transfer of personal data, BBC uses appropriate contractual safeguards, adequacy arrangements or other transfer mechanisms permitted by applicable law.

8. Retention
BBC retains personal data for as long as reasonably necessary for the purposes for which it was collected and to comply with applicable accounting, tax, legal and regulatory requirements.
Customer and transaction information generally may be retained throughout the business relationship and for the applicable record-retention period thereafter. Records associated with BBC’s Netherlands Agent may be retained for at least seven years where required by Dutch accounting or tax law. Information relating to an unsuccessful credit application generally may be retained for up to two years after the application or last relevant business contact. BBC may retain information for a longer period where reasonably necessary in connection with an outstanding balance, dispute, investigation or legal claim.
9. Security
BBC maintains reasonable technical and organizational measures designed to protect personal data against unauthorized access, loss, misuse, alteration and disclosure. Customers submitting credit applications or financial information should use the submission method designated by BBC.
10. Your Rights
Subject to applicable law, individuals may have the right to request access to personal data held about them; request correction of inaccurate or incomplete information; request deletion or restriction of processing; request portability of certain personal data; and lodge a complaint with an applicable data-protection authority. A request for deletion does not require BBC to delete information that it is legally required or otherwise permitted to retain, including business, accounting, credit, collection and legal records.
YOUR RIGHT TO OBJECT
Where BBC processes personal data on the basis of its legitimate interests, you have the right to object to that processing on grounds relating to your particular situation. BBC will consider any objection in accordance with applicable data protection law and will cease the relevant processing where required to do so.
11. Complaints
Individuals in the European Economic Area may lodge a complaint with the data-protection supervisory authority applicable to them. For matters relating to BBC’s Netherlands Agent, the relevant supervisory authority is the Autoriteit Persoonsgegevens, the Dutch Data Protection Authority. Individuals in the United Kingdom may lodge a complaint with the Information Commissioner’s Office (ICO).
Individuals in the United Kingdom also have the right to complain directly to BBC regarding its processing of their personal data, including in relation to the exercise of their data protection rights.
